Acceptance of Terms
These Terms of Service form a binding agreement between you and Anywhere ("Anywhere", "we", "us"). By creating an account, booking a screen, generating a creative, or otherwise using the Anywhere app, you agree to these Terms and to our Privacy Policy. If you are using Anywhere on behalf of a company, you confirm you are authorised to bind that company, and "you" means that company. If you do not agree, do not use Anywhere.
Who We Are
Anywhere is an advertising marketplace that connects advertisers with owners and operators of out-of-home advertising screens and digital advertising inventory. We are not the owner of the physical screens or the digital placements; those are operated by third-party media partners and their content-management-system (CMS) partners. Anywhere facilitates discovery, booking, payment, creative review, and campaign delivery between you and those partners.
The Service
Through Anywhere you can: browse a location-based map of available outdoor screens (billboards, mall, metro and street displays) and digital placements (web, app and in-game inventory); see indicative pricing, traffic and specifications for each; upload your own creative or generate one with our AI tools; submit and pay for a booking; and track each campaign through review, live delivery and completion in My Bookings. Features, inventory and pricing may change or be withdrawn at any time.
Eligibility & Accounts
You must be at least 18 years old and using Anywhere for business or professional advertising purposes. You can sign in with a one-time email code, Apple, or Google; you may link more than one of these to the same account. You are responsible for keeping access to your sign-in methods secure, for the accuracy of the information you provide, and for all activity under your account. Tell us promptly at support@anywhere.ad if you believe your account has been accessed without your authorisation.
Booking Screen Time
Each booking reserves a defined number of plays or impressions on a specific screen or placement over the dates you choose. Availability is limited and is confirmed only when your booking is accepted and paid. Submitting a booking reserves that inventory immediately and removes it from the pool available to other advertisers. A booking does not guarantee any particular audience, footfall or business outcome beyond delivery of the reserved plays or impressions, subject to these Terms.
Pricing & Payment
Prices for screen bookings are calculated by our servers from the screen, your selected play frequency, the number of days, and current demand and inventory, and the full amount is shown before you confirm. Amounts are displayed in US dollars unless stated otherwise and are exclusive of any taxes that may apply. Card payments are processed by Stripe through a secure payment sheet; your full card details are never sent to or stored by Anywhere. If the server-computed price changes while you are paying, the charge is reversed and the booking is not created, and you will be asked to try again.
Points & AI Creative Generation
Points are a virtual item used to generate creatives with our AI tools inside the app. Points are sold only through the Apple App Store or Google Play and those purchases are governed by the store's terms; RevenueCat processes them on our behalf. Points have no cash value, are not a stored-value or payment instrument, cannot be transferred or exchanged for money, and are non-refundable except where the store's policy or applicable law requires otherwise. Points are consumed when a generation request is sent, whether or not you use the result. AI-generated output may be inaccurate, generic, or similar to other output, is provided without any warranty of originality or fitness, and you are responsible for reviewing it and for your use of it. Prompts and related context you submit are sent to third-party AI providers to produce the result (see the Privacy Policy).
Your Creative Content
You keep ownership of the creative assets and prompts you upload or generate. You grant Anywhere and the relevant media and CMS partners a worldwide, non-exclusive, royalty-free licence to host, reproduce, adapt for technical formatting, transmit and publicly display that creative for the purpose of reviewing and running your campaign for its duration. You represent and warrant that you hold all rights needed to grant that licence, that the creative and its claims are lawful, accurate and not misleading, and that it does not infringe any third party's intellectual property, privacy or other rights.
Content Review & Compliance
Every submitted creative is checked before it can go live, using a combination of automated review and human review, against our general content policy and any additional content guidelines that apply to the specific screen (shown to you on the screen's Terms & Conditions before you book). We may reject, delay, or remove any creative or campaign that we or a partner reasonably believe breaches those guidelines, any partner requirement, or any applicable law or regulation, at any time and without notice. Where a creative is rejected in review, the booking is not charged or is refunded as described below.
Cancellations & Refunds
Because inventory is reserved as soon as you submit a booking, screen bookings are non-refundable once the creative has been submitted for review. Refunds are issued only where: the booking is rejected during review; a confirmed technical failure on our side or a partner's side prevented the reserved plays or impressions from being delivered; or a refund is required by applicable law. Approved refunds are returned to the original payment method. Purchases of Points are handled under the applicable app store's refund policy, not by Anywhere directly.
Screens, Partners & Availability
Screens and digital placements are operated by third-party media partners and their CMS partners (for example Broadsign, Scala or SignageOS). Anywhere does not control their systems, schedules, uptime or editorial decisions, and is not responsible for partner outages, maintenance, force-majeure events, or a partner's independent decision to decline content. Inventory figures, traffic estimates and specifications are provided by partners and are indicative, not guaranteed. If delivery is materially short of what you reserved for reasons within our or a partner's control, your remedy is a pro-rata refund or re-delivery at our option.
Acceptable Use
You agree not to: submit content that is unlawful, deceptive, defamatory, or infringing; use Anywhere to advertise products or services you are not licensed to offer; attempt to bypass or interfere with content review, pricing, or inventory controls; scrape, resell, or provide access to the service or its data to third parties without our written consent; or interfere with the security or operation of the app or its infrastructure.
Our Intellectual Property
The Anywhere app, its name and logo, its user interface, and the data and software behind the marketplace are owned by Anywhere or its licensors and are protected by intellectual-property laws. These Terms do not grant you any right to use the Anywhere brand except as needed to use the service as intended.
Disclaimers
Anywhere is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted or error-free. This does not exclude any warranty or right that cannot be excluded under applicable law.
Limitation of Liability
To the fullest extent permitted by law, Anywhere is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or business, arising out of or relating to your use of the service, screen downtime, partner CMS outages, review outcomes, or AI-generated output. Our total liability for any claim relating to the service is limited to the amount you paid to Anywhere for the booking or purchase giving rise to the claim in the three months before the claim arose.
Indemnification
You agree to indemnify and hold Anywhere and its media and CMS partners harmless from claims, losses and expenses (including reasonable legal fees) arising from your creative content, your advertising claims, your breach of these Terms, or your violation of any law or third-party right.
Suspension & Termination
You may stop using Anywhere and delete your account at any time from the app. We may suspend or terminate your access if you breach these Terms, if required for legal or security reasons, or if a partner withdraws the inventory you have booked. Sections that by their nature should survive termination (including content licences already granted for running campaigns, payment obligations, disclaimers, liability limits and indemnities) continue to apply.
Governing Law & Disputes
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to conflict-of-laws rules. The courts of Dubai have exclusive jurisdiction over any dispute arising from these Terms or your use of Anywhere, unless mandatory local law provides otherwise.
Changes to These Terms
We may update these Terms as the service evolves or as legal requirements change. We will update the "last updated" date and, for material changes, give notice in the app. Continuing to use Anywhere after an update takes effect means you accept the revised Terms.
